Terms of Service

Section 1: Introduction and Acceptance

These Terms of Service ("Terms") govern your access to and use of the TurnoHub platform ("Service"), operated by TurnoHub, reachable at [email protected]. By registering for or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

These Terms constitute a legally binding agreement between you ("Business User") and TurnoHub. Use of the Service by your end-clients (the clients of your barbershop, salon, tattoo studio, or other service business) is subject to any terms you, as the Business User, establish with them.

Section 2: Description of Service

TurnoHub is a cloud-based Software-as-a-Service (SaaS) platform providing booking management, client relationship management (CRM), QR-code booking, AI-assisted client interactions, and business analytics tools designed for service businesses.

TurnoHub is a technology platform only. We provide tools that facilitate your business operations. TurnoHub is not a party to any agreement, appointment, service, or transaction between you and your end-clients. All such relationships are solely between you and your clients.

Section 3: Eligibility and Account Registration

To use TurnoHub you must:

• ✓Be at least 18 years of age
• ✓Be a legal entity or individual acting in a professional or business capacity
• ✓Provide accurate, complete, and up-to-date registration information
• ✓Maintain the confidentiality of your account credentials

You are solely responsible for all activity that occurs under your account. TurnoHub shall not be liable for any loss resulting from unauthorised use of your account.

Section 4: Subscription Plans and Billing

4.1 Plans

TurnoHub offers the following subscription plans, billed monthly:

• ✓Solo Plan — €29.00 per month (excluding applicable taxes)
• ✓Pro Plan — €59.00 per month (excluding applicable taxes)

4.2 Free Trial

New Business Users may access the Service free of charge for fourteen (14) calendar days (the 'Free Trial'). No payment information is required during the Free Trial unless you choose to subscribe. At the end of the Free Trial, access is suspended unless you activate a paid plan.

4.3 Automatic Renewal

Subscriptions renew automatically on a monthly basis unless cancelled by you at least twenty-four (24) hours before the renewal date. By providing payment details, you authorise TurnoHub (via its payment processor, Lemon Squeezy) to charge the applicable subscription fee on each renewal date.

4.4 Price Changes

TurnoHub reserves the right to modify subscription prices upon not less than thirty (30) days' written notice. Continued use of the Service after the effective date of a price change constitutes your acceptance of the new pricing.

4.5 Taxes

Prices shown may be exclusive of value added tax (VAT) or other applicable taxes. You are responsible for any taxes applicable to your subscription in your jurisdiction. Lemon Squeezy, our payment processor, handles VAT collection where legally required.

Section 5: No Refund Policy

All fees paid are non-refundable, except as required by applicable mandatory consumer law. TurnoHub subscriptions are sold to business entities or individuals acting in a professional capacity (B2B transactions), and accordingly statutory consumer cooling-off rights under Directive 2011/83/EU do not apply.

We strongly encourage you to use the fourteen (14) day Free Trial to evaluate the Service before subscribing. No partial-month refunds will be issued upon cancellation mid-cycle; your access continues until the end of the then-current billing period.

In the event of a verified billing error attributable to TurnoHub, we will issue a credit or refund as appropriate.

Section 6: Cancellation

You may cancel your subscription at any time by accessing your account settings or contacting [email protected]. Cancellation takes effect at the end of the current billing period. Following cancellation, you will have access to your data for thirty (30) days during which you may export your information. After thirty (30) days, your data may be permanently deleted in accordance with our Privacy Policy.

Section 7: Acceptable Use

You agree not to use the Service to:

• ✓Violate any applicable law or regulation
• ✓Infringe upon the intellectual property rights of any third party
• ✓Transmit spam, unsolicited commercial communications, or malware
• ✓Attempt to gain unauthorised access to TurnoHub systems or other users' accounts
• ✓Collect or harvest personal data of any person without lawful basis
• ✓Engage in any conduct that disrupts, damages, or interferes with the Service

TurnoHub reserves the right to suspend or terminate accounts found in breach of this section without prior notice.

Section 8: Intellectual Property

All software, design, trademarks, content, and technology comprising the Service are the exclusive property of TurnoHub or its licensors. These Terms do not grant you any right, title, or interest in the Service beyond a limited, non-exclusive, non-transferable licence to use it in accordance with these Terms.

You retain ownership of all data and content you upload to the Service ('Your Data'). By uploading Your Data, you grant TurnoHub a limited licence to process and store it solely for the purpose of providing the Service.

Section 9: AI Assistant

The Service includes an artificial intelligence (AI) assistant powered by third-party AI technology. The AI assistant is provided as a convenience tool only. Responses generated by the AI assistant are automated and may not always be accurate, complete, or appropriate. TurnoHub makes no warranty as to the accuracy of AI-generated content, and you should not rely solely on it for any business, legal, medical, financial, or other critical decisions.

Your use of the AI features is also subject to the terms and policies of the relevant AI provider (Anthropic, Inc.).

Section 10: Service Availability and Limitation of Liability

10.1 Service Availability

TurnoHub endeavours to maintain high service availability but does not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, or events beyond our reasonable control.

TurnoHub relies on third-party sub-processors and infrastructure providers (including Supabase, Lemon Squeezy, Resend, and Anthropic). TurnoHub is not responsible for the acts or omissions of such third parties, including outages, data breaches, or service changes on their part.

Section 11: Relationship Between Parties

Nothing in these Terms creates a partnership, joint venture, agency, employment, or franchise relationship between TurnoHub and the Business User. TurnoHub is an independent service provider.

TurnoHub is not a party to any contract, transaction, or dispute between a Business User and that Business User's end-clients. You are solely responsible for your compliance with all laws applicable to your business and to your client relationships.

Section 12: Data Protection

The processing of personal data in connection with the Service is governed by our Privacy Policy and, where applicable, our Data Processing Agreement. By using the Service, you acknowledge and agree to those documents.

• ✓TurnoHub acts as a Data Controller in respect of Business User personal data.
• ✓TurnoHub acts as a Data Processor in respect of end-client personal data processed on your behalf.
• ✓You, as Business User, are the Data Controller for your end-clients' data.

Section 13: Modifications to These Terms

TurnoHub reserves the right to update these Terms at any time. Material changes will be communicated by email to the address associated with your account at least thirty (30) days before the effective date. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.

Section 14: Termination

Either party may terminate these Terms at any time. TurnoHub may suspend or terminate your access immediately if you breach these Terms, are involved in fraudulent activity, or if required to do so by law. Upon termination, the provisions of Sections 8, 10, 14, 15, and 16 shall survive.

Section 15: Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Spain. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Valencia, Spain, without prejudice to any mandatory local consumer protection laws that may apply in the Business User's jurisdiction.

Section 16: General

If any provision of these Terms is found to be unenforceable, it will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force. No waiver of any right under these Terms shall be effective unless in writing. These Terms, together with the Privacy Policy and any applicable DPA, constitute the entire agreement between you and TurnoHub with respect to the Service.
